Recently the COVID-19 Omnibus (Emergency Measures) Bill 2020 passed Parliament. This new legislation temporarily amends a number of Acts in order to temporarily modify the application of some of the laws of Victoria for the purpose of responding to the COVID-19 pandemic. One of the temporary modifications requires the WorkCover Authority or a self-insurer to give 39 weeks notice rather than 13 weeks notice that a worker's entitlement to weekly payments will terminate after the expiry of the second entitlement period. This applies temporarily for determinations made on or after 1 December 2019 until 6 months after the commencement of this new temporary law. In effect this entitles some workers to remain on payments for an extended period of time in recognition of the increased barriers long-term injured workers already face returning to work or obtaining new employment, which have been compounded due to the COVID-19 pandemic.
